Provisional patent application is developed to protect the idea of old invention from copying. Old invention here means the idea of a particular invention was developed long back but the actual product is not brought into force till date. After completing the formalities of provisional patent filing, the effective filing date of the particular patent is established and is sealed with a mark called “patent pending”. This will last for a duration of one year from the date of provisional patent filing.

It is required to conduct investigations of the previous inventions. This is to make sure that the invention is purely true, and it does not have any relation with the previous inventions. After verification of the provisional patent application, the patent examiners will start with the “prior art” process.

This process is for finding any similarities or duplication of idea of any previous inventions. In case of similarities with earlier inventions, the examiner will not grant the provisional patent application.
